Cambridge Online Learning Support (“we”, “us”, “our”).
Cambridge online Learning Support provides online information and teaching and learning solutions for students preparing for competitive entrance examinations for Independent Senior schools in London and the UK and Cambridge International Examinations.
By accessing the Website you agree to be bound by the Terms and Conditions below. We may, at our absolute discretion, change these Terms and Conditions at any time and by accessing the Website you agree to be bound by the latest version of the Terms and Conditions. If you do not agree to be bound to the Terms and Conditions you should no longer use the Website.
2. Intellectual Property
All the content included on the Website is the property of Cambridge On Line Learning Support and/or the suppliers of the content. All such property falls under the protection of International copyright and intellectual property laws. Copying, extracting, publishing or reproducing information or content from the Website is prohibited without our express prior written permission.
3. Paid Subscription Sign Up
Payment of a subscription gives you a license to access the content specified when you pay the subscription for the duration of time specified. Cambridge On Line Learning Support reserves the right to change the amount or type of content available at any time. Any decision made by Cambridge On Line Learning Support to change the content available on the Website will be final and not subject to any appeal whatsoever.
Each subscription is personal and may only be used by one person and it is prohibited for you to share, lend, give or sell your paid subscription to others, including, without limitation, allowing a 3rd party to use your login. As such your account details should not be shared in any way.
Paid subscriptions should be used for personal use. Commercial use of subscription content is prohibited without the prior written agreement of Cambridge On Line Learning Support.
4. Sign Up Details
Usernames and passwords should be kept confidential. Cambridge On Line Learning Support reserves the right at its absolute discretion to withdraw your username and password if, in the opinion of Cambridge On Line Learning Support you fail to comply with these terms. Any decision made by Cambridge On Line Learning Support to withdraw a license will be final and not subject to any appeal whatsoever.
5. Payment for Subscription
Payment is made by online credit or debit card payment. If payment was made unintentionally, Cambridge On Line Learning Support must be informed within 24 hours of such payment being made. You will only receive a refund if no use has been made of your account. Cambridge On Line Learning Support will not provide refunds to anyone who has made any use of their account after payment.
6. Account Closure
Cambridge On Line Learning Support reserves the right at its absolute discretion to close your account without prior notice and without reason. If, in the sole opinion of Cambridge On Line Learning Support, your account is closed due to a breach of the Terms and Conditions then you will receive no refund in respect of your subscription.
If you have paid for a subscription and your account is closed for any other reason other than breaching the Terms and Conditions, you may receive a refund that will be calculated on the basis of how many days you have had access to your account on a pro-rata basis.
If Cambridge On Line Learning Support closes your account you will no longer be able to access the content of the site.
7. Website Access
Cambridge On Line Learning Support does not accept any liability for the Website becoming unavailable at any time due to circumstances that it does not directly control, including, without limitation: interruption or failure of any power supply; failure of firmware, hardware or software; or interruption of any telecommunication or other network.
8. Links to Other Websites
The Website may contain links to other websites. Unless otherwise stated we do not control these sites. We accept no responsibility for the sites that we link to and make no assurances as to their accuracy, reliability or quality.
If you submit feedback Cambridge On Line Learning Support reserves the right to publish that feedback, or any portion of it, on our testimonials page or within marketing material. Cambridge On Line Learning Support will only ever publish your first name and whether you are a parent, tutor teacher, school or pupil unless you have given express permission of us to publish your full name.
The content made available by Cambridge On Line Learning Support is for information purposes only. Cambridge On Line Learning Support makes no representations or warranties as to the accuracy, reliability or quality of the information and content on the Website. As such, content should not be relied upon as accurate or correct. Cambridge On Line Learning Support does not make any representations or warranties as to the performance of any user or child as a result of using Cambridge On Line Learning Support or the Virtual Learning Environment.
Cambridge On Line Learning Support’s liability will be limited to the value of a subscription (if any) that has been paid for by the user. Beyond this, to the extent permitted by law, Cambridge On Line Learning Support does not accept any liability for any loss or damage incurred or suffered as a result of using the Website.
Cambridge On Line Learning Support does not accept any liability for any negative impact on a child or user as a result of using the Website.
Use of Cambridge On Line Learning Support by you or any person for whom you pay for subscription is undertaken entirely at your own risk.
If any part of these Terms and Conditions contravenes any relevant law, to the extent that such a provision is invalid or unenforceable, it shall be deemed to be removed and the remaining Terms and Conditions shall not be affected and will remain valid and enforceable.
12. Online Tutoring:
Once an on line tutoring lesson has been confirmed, it is your responsibility to ensure that you participate in the tutorial at the time specified.
We have used all reasonable endeavours to ensure that our tutors are suitable. You accept that no warranty as to the suitability of the Tutor can be given by us.
12.2 Cancellation, Refunds and Termination
If you need to cancel or change a lesson, please contact Cambridge On Line Learning Support as early as possible. Tutorials that are cancelled by you with less than 24 hours’ notice will be charged for in full. If you make a cancellation with more than 24 hours’ notice the lesson will be credited back to your account. Hours purchased but not used cannot be refunded. Any refunds will be made at the sole discretion of Cambridge On Line Learning Support .
In the event that you reasonably believe that the Tutor is unsuitable, please let us know as soon as possible. We will use reasonable endeavours to find a replacement Tutor for you.
If you have a complaint against the Tutor or against us, you must inform us of that complaint within 24 hours of the occurrence that gave rise to it.
We supply each tutor in good faith and in the belief that he or she will perform to the best of his or her abilities. However, we cannot guarantee the performance of the Tutor. Any opinion expressed by the Tutor is not necessarily an expression of the opinions of Cambridge On Line Learning Support.
Neither Cambridge On Line Learning Support nor any of its staff shall be liable to you for any loss, injury, damage, expense or delay incurred or suffered by you arising directly or indirectly from or in any way connected with the use of an on line tutorial. This includes:
· failure of the Tutor to meet your requirements for all or any of the purposes for which he or she is required by you;
· any act or omission of a Tutor, whether wilful, negligent, fraudulent, dishonest, reckless or otherwise; and
· any loss, injury, damage, expense or delay incurred or suffered by a Tutor,
provided that nothing in this clause shall exclude or restrict the liability of Cambridge On Line Learning Support to you for death or personal injury resulting from negligence or for fraudulent misrepresentation or in any other circumstances where liability may not be so limited under any applicable law.
12.4 Private Arrangements
You are not permitted to make private arrangements for tuition with Tutors used by us. By confirming an on line tutorial lesson, you undertake not to make any such arrangements with any Tutor registered with us either during the term of this Agreement or at any time following its termination.
No modification or variation of this Agreement shall be effective unless a director of Cambridge On Line Learning Support consents in writing to such modification or variation. We will notify you in writing of any changes.
If any provision of this Agreement is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions hereof and the remainder of the provision in question shall not be affected thereby.
Any waiver of any breach of, or default under, any of the terms of this Agreement by us, shall not be deemed a waiver of any subsequent breach or default and shall in no way affect the other terms of this Agreement.
We shall be entitled to transfer or assign the benefit and/or burden of this Agreement.
The expiration or termination of this Agreement, howsoever arising, shall not operate to affect such of the provisions of this Agreement as are expressed to operate after then.
This Agreement does not create any rights or benefits enforceable by any person not a party to it (within the meaning of The Contracts (Rights of Third Parties) Act 1999).
Neither party shall have any liability under or be deemed to be in breach of this Agreement for any delays or failures in performance of this Agreement which result from circumstances beyond the reasonable control of that party. The party affected by such circumstances shall promptly notify the other party in writing whether such circumstances cause a delay or failure in performance and when they cease to do so. If such circumstances continue for a continuous period of more than 2 weeks, either party may terminate this Agreement by written notice to the other party.
These terms and any non-contractual obligations arising out of or in connection with them shall be governed by English law and you hereby submit to the exclusive jurisdiction of the English Courts for the adjudication of any dispute in connection with these Terms and Conditions.
